小田急線高架化事業認可を東京地裁が取消し判決
Court judged against permission of Odakyu Line elevation

高架複々線化工事が進む小田急線について、
この日東京地裁が
「国の事業認可」
を違法として取り消す判決を言い渡した。
この裁判の原告は小田急線の地下化を主張している。
それだけならよくある話かなと思うが、
彼らはあろうことか
「地下化の方が高架化より安い」
と主張している。
地下化すれば用地買収はほとんど不要となるばかりか、
現在の敷地を売却することさえ可能、
というのがその論拠らしい。
しかし、
この議論にはどうみても無理がある。
現在の用地まで売却することを電鉄会社に強制できるかは疑問だし、
それができたところで現在の用地を宅地等にして売れるわけでもない。
細長い公園緑地として使う以外ないと思うが、
それでは
「地下化の方が安い」
という論拠は崩れてしまうことになる。
それに、
このグループは地下化の工事費を非常に甘く見ているといわざるを得ない
(例:急行線には駅は不要と主張しているが、
緊急時の避難等のために事実上駅並みの設備が必要。
西武新宿線の地下複々線化計画が頓挫した理由の一端は、
こうした事情のため建設費が当初見込みより高騰したことにある)。
また、
地下化によって開通後の鉄道企業
(あるいは鉄道利用者)
の負担が大幅に増えたり、
列車の運行に大きな制約がついたりすることも無視している。
騒音・振動問題も問題にされたようだが、
すでに高架複々線化が完成した狛江地区などでは画期的に改善された、
という意見もある。
原告側は
「初めに高架化ありき」
の議論と批判するが、
これでは原告の主張も
「初めに地下化ありき」
だと批判することが可能であろう。
だが、
今後この種の工事を進める人々は、
これを重い教訓としてとらえる必要があるだろう。
原告123人のうち
「原告適格」
と認められたのがわずか9人、
しかもその主張する内容には以上のように疑問が多い。
こういう人たちでも裁判で勝ってしまう、
という状況ができた背景には、
被告側がきちんとした立証・説明責任を果たさなかった、
という意味でのずさんさがあるとはいえる。
技術的におかしな主張も、
オーソライズするのはプロではない裁判所、
というわけだ。
だから、
とんでもない主張だと思ったのなら、
無視するのではなく
「徹底的にたたく」。
その過程で彼らが納得しなくても、
他の多くが納得すれば、
仮に今回のように裁判になったとしても十分に勝てるはずだ。
つまり、
議論をたたかわせることが、
ますます重要な時代になった。
もちろん、
こういう裁判になる
「前」
に、
だが。
このあと、
国が控訴したというニュースが入ってきているが、
致し方ないことだと思う。
The District Court of Tokyo decided that the Government's permission
on urban planning, which formed the basis of the project of elevating
and quadruple-tracking the Odakyu Line, one of the suburban private
railways west of Tokyo, is in illegal condition and is void.
The accusers who filed the lawsuit are basically the local citizens who
live alongside the line. Their request was that the line should go
underground instead of being elevated. This kind of claim frequently
happens when the similar rail projects are in progress; however, they
insisted that digging the tunnel is cheaper than elevating the line!
This conclusion seems to have come from the fact that the
land currently occupied by the line can be sold after all the tunnelling
is complete.
However, this is clear nonsense. There are doubts about whether or not
we can force the railway company to sell the land which they currently
own; even if we can, it is very difficult to actually sell it as, for
example, residential estates. The land will only be a long green belt,
but then the cost of tunnelling can never be recovered.
In addition, this group apparently underestimates the cost of construction
of underground quadruple-track lines (E.g., the tunnel for non-stop
trains should have station or something equivalent at a number of places
to facilitate emergency escape routes, which the group neglects).
They also neglect the fact that train operators (or passengers) suffer from
increased costs or inconveniences, or some added constraints in train
operations.
One of the main concerns by the accusers, the noise and vibration problems,
were said to be significantly improved in the already completed section
in the Komae City area. This technical improvements were also neglected.
The accusers insisted that the promoters of the project made the arguments
based on elevating the line and made no considerations on tunnelling. The
same does apply, however, to the arguments by the accusers in the sense
that theirs are the one based on tunnelling and made no considerations on
elevating.
This will be an important lesson for people involved in this kind of projects
in Japan. According to the decision, out of 123 accusers only nine were
accepted as eligible for the claim. The contents of the claim are,
as discussed earlier, quite doubtful from the technical points of view.
The fact that this kind of people can win in the lawsuit means
that the promoters have made little efforts to explain and persuade
these people.
If there is any claim which is technically incorrect,
the court which consists of non-engineers will authorise it.
This means that the wrong things should be, not "neglected",
but "defeated to a full extent", in the arguments beforehand.
If the promoters succeeded in persuading many of the people, they
can even win the lawsuit filed by the opponents. It is this
kind of arguments that have now become important in the promotion of this kind
of projects --- before the lawsuit, of course.
The newest report said that the government appealed to the Higher Court,
which seemed inevitable to me.
